"Dispute Referred To Arbitration Under MSME Act; Court Can Extend The Mandate Of Arbitrator.......
The Gujarat High Court has ruled that even in cases where the dispute has been referred to arbitration under the Micro, Small and Medium Enterprises Development Act, 2006 (MSME Act), the Court is empowered under Section 29A of the Arbitration and Conciliation Act, 1996 (A&C Act) to extend the mandate of the Arbitral Tribunal. The Single Bench of Chief Justice Aravind Kumar held that in view of Section 18(3) of the MSME Act, the provisions of the A&C Act would be applicable once the dispute is referred to arbitration under the MSME Act. Hence, the Court can extend the mandate of the Arbitral Tribunal under Section 29A of the A&C Act.
